President Accepts Resignation of Government Officials

The President of Ukraine, Victor Yanukovych has accepted the resignation of Prime Minister Mykola Azarov.


The Prime Minister submitted his letter of resignation to the President on December 3rd.  In it he wrote: "In view of having been elected as a People's Deputy of Ukraine, and in accordance with Part 2 of Article 115 of the Constitution of Ukraine, Article 15 of the Law on The Cabinet of Ministers of Ukraine, I hereby announce my resignation".


Article 115 of the Constitution states that if the Prime Minister resigns, every member of the Cabinet of Ministers must also submit a resignation; for this reason the President also accepted resignations from each member of the Cabinet of Ministers.


However, as per Part 5 of Article 115 of the Constitution, the President ordered the Cabinet of Ministers to continue functioning uninterrupted until a newly-formed Government is established.


In accordance with Part 3 of Article 17 of the Law on the Cabinet of Ministers of Ukraine, resignations take effect only after the newly formed Cabinet of Ministers starts functioning.  Thus, all current members of the Government will continue to carry out their duties as stipulated in the Constitution.


In accordance with applicable law, the Prime Minister of Ukraine shall be appointed by the President provided that at least a half of the Constitutional Majority of the Verkhovna Rada approves it.  A written application for approving a Prime Minister's assignment is submitted by the President to the Verkhovna Rada after the previously appointed members' resignations have been accepted, terminating the Prime Minister's powers.  The Parliament has 5 days to consider the President's application (paragraph 12, Part 1 of Article 85, paragraph 9, Part 1 of Article 106, Part 2 of Article 114 of the Constitution, Article 8 of the Law on the Cabinet of Ministers of Ukraine, Article 205 of Regulations on Verkhovna Rada, stipulated by the law on Regulations on Verkhovna Rada).
